These Terms and Conditions (“Terms”) govern the relationship between JLG Ventures, LLC, operating as Burnout CEO Travel (“BCT”, “we”, “us”, or “our”) and you, the purchaser or traveler (“Client”, “passenger”, “you”, or “your”).

By planning travel with BCT, you agree to be bound by these Terms and acknowledge that BCT acts solely as a booking agent for disclosed principal suppliers, including tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation providers, boat operators, and other independent contractors providing accommodations, transportation, and other services (“Suppliers”). BCT is not the source or provider of the travel services themselves.

These Terms include warranties, disclaimers, and exclusions of liability. They may restrict your rights and remedies, and they provide protection to BCT.

1. Use of BCT Services

You warrant that you are at least 18 years of age and have the legal authority to enter into this agreement and to make travel bookings with BCT. You agree to be financially responsible for all travel bookings you make with us, whether for yourself or for other members of your traveling party. You warrant that all information you supply, on behalf of yourself, members of your household, or others for whom you are authorized to transact business, is true and accurate. You agree to make only legitimate reservations or purchases with BCT and its Suppliers. Speculative, false, or fraudulent reservations are prohibited.

BCT accepts all bookings solely as the booking agent for the travel Suppliers on your itinerary. Separate Supplier terms and conditions apply to your reservation and purchase of travel-related goods and services. By booking travel through BCT, you agree to the booking terms of each Supplier on your itinerary.

BCT is not liable or responsible for any arrangements you make independently of BCT. BCT assumes no responsibility for costs or fees you incur for arrangements not booked through us, including airline, hotel, excursion, and travel protection charges. If you make your own flight arrangements, BCT is not responsible for any loss resulting from cancellations or changes in international gateways, itineraries, or travel dates, and we cannot assist with schedule changes or delays related to air reservations you have made on your own. Frequent flyer or loyalty points may not be earned for reservations on your itinerary, and with limited exceptions, hotel and airline rewards or points cannot be redeemed for travel arrangements made by BCT.

BCT operates as an independent contractor and independent agent of Archer Travel Service, Inc. (“Archer”), under Archer’s industry accreditation IATAN / ARC / CLIA #05824840. Where state Seller of Travel registration is required for the jurisdiction in which a transaction occurs, BCT books under Archer’s applicable state registrations: Florida Seller of Travel #35395, California Seller of Travel #CST 2001330-10, Hawaii Seller of Travel #TAR-6612, and Washington Seller of Travel #603352551.

2. Right to Correct Errors; Offers Subject to Availability

We reserve the right to correct errors. In the event of a pricing error or omission, we reserve the right to adjust pricing or make any other corrections. All offers, incentives, and Supplier promotions are subject to availability and may change without notice. Confirm reservations well in advance of your anticipated travel dates to avoid disappointment, fare increases, and late booking fees.

3. Payments, Cancellations, and Changes to Bookings

You are completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through BCT. By submitting a credit card authorization form to BCT, you authorize BCT to use your payment method to purchase travel products from our Suppliers on your behalf.

EXCEPT IN CASES OF FRAUD, YOU AGREE NOT TO FILE ANY DISPUTE WITH YOUR BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE THE BOOKING TERMS AND CONDITIONS OF BCT OR ITS SUPPLIERS, INCLUDING CANCELLATIONS OR CHANGES OF ITINERARY OR ARRANGEMENTS FOR REASONS BEYOND THE CONTROL OF BCT OR ITS SUPPLIERS. IF YOU ATTEMPT TO CHARGEBACK, REVERSE, OR RECOLLECT A PREVIOUSLY AUTHORIZED TRIP PAYMENT, BCT RESERVES THE RIGHT TO COLLECT ALL ADDITIONAL COSTS, FEES, AND EXPENSES ASSOCIATED WITH SUCH CHARGEBACK, REVERSAL, OR RECOLLECTION, INCLUDING REASONABLE ATTORNEY’S FEES.

All payments for travel are due prior to departure according to each Supplier’s terms. Suppliers may require non-US travelers to make payments in United States Dollars. Failure to make final payment, or any violation of a Supplier’s conditions of purchase, may result in cancellation of your reservations, denial of access to flights, tours, hotels, cruises, or other travel services, or forfeiture of monies paid.

In some cases, there is no refund once a booking is made and under deposit. You may not be entitled to a refund if you change or cancel your travel plans after a booking is confirmed. All cancellation requests must be sent to BCT in writing. BCT and Supplier cancellation penalties will apply, and cancellation fees will be charged to your authorized payment method or deducted from any Supplier refund.

If you decide to change any portion of your confirmed arrangements before departure or during your trip, we will attempt to assist you. Certain bookings cannot be changed, and you will be responsible for any cost increases imposed by the Supplier, as well as any BCT or Supplier change fees. All change requests must be made in writing. When tour, cruise, or package prices are based on Supplier contract rates, you are not entitled to any refund for unused portions of travel.

4. Travel Documents and Identification Requirements

It is your responsibility to obtain and carry a valid passport book, visas, and all other documents required by applicable government regulations. Passport cards are not accepted for most international travel.

For domestic and international travel, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) require acceptable identification to board a flight. Information on acceptable identification is available at https://www.tsa.gov/.

Many countries deny entry if a passport expires within six months of the anticipated return date. Non-US citizens may require additional documentation, and you are responsible for informing BCT when traveling on a non-US passport. BCT does not control or warrant the issuance of visas or the approval of visa waivers. If a visa is not issued, BCT is not responsible for lost payments toward your trip. Entry and exit rules can change at any time.

Children and infants may also require travel documents. Minors traveling with one parent, or without both parents, may be denied entry unless authenticated and verified consent forms are provided. See https://help.cbp.gov for additional information. Parental or legal guardian consent must be provided in writing to the supervising adult or group leader for minors traveling without parents.

The name, date of birth, and gender on your identification must exactly match the data on your tickets and booking records. You acknowledge that it is your responsibility to verify that the information on your tickets and confirmations is accurate. Any discrepancy may result in denied boarding or significant delays at security checkpoints.

WHEN YOU RECEIVE YOUR TRAVEL DOCUMENTS, IT IS YOUR RESPONSIBILITY TO REVIEW AND VERIFY ALL INFORMATION FOR ACCURACY. CONTACT BCT IMMEDIATELY IF CHANGES OR CORRECTIONS ARE REQUIRED. IF YOU HAVE NOT NOTIFIED US OF NECESSARY CORRECTIONS WITHIN TWENTY-FOUR (24) HOURS OF RECEIVING YOUR TRAVEL DOCUMENTS, BCT BEARS NO RESPONSIBILITY FOR ANY ADDITIONAL COSTS ASSOCIATED WITH MAKING THOSE CORRECTIONS.

5. Individual Entry and Exit Requirements

Countries treat past criminal offenses differently. If you have a current or prior criminal offense, contact the destination country directly for entry and exit requirements. The US State Department maintains country-specific information at https://travel.state.gov/content/travel.html. We do not inquire about a Client’s criminal record out of respect for privacy. As one example, individuals with a Driving While Intoxicated record or unpaid child support judgments should review Canadian entry requirements at https://www.canada.ca before traveling to or through Canada.

6. Immunizations and Health Screenings

You are responsible for obtaining the proper immunizations, health screenings, and required documentation before travel. BCT does not assume responsibility for the accuracy of health, vaccination, or documentation requirements at departure or arrival. Some destinations require inoculations to be recorded by your health practitioner on a valid vaccination certificate that you must carry as proof.

If you have concerns about medications or inoculations, consult your health practitioner before booking. Reference resources include the US State Department at https://travel.state.gov and the Centers for Disease Control at https://wwwnc.cdc.gov/travel/.

7. Risks and Safety

Travel to certain destinations involves greater risk than others. BCT urges Clients to stay informed of current events, travel prohibitions, warnings, announcements, and advisories issued by the United States Government before booking international travel. Useful resources include https://www.state.gov, https://www.tsa.gov, https://www.dot.gov, https://www.faa.gov, https://www.cdc.gov, and https://www.cbp.gov.

The Smart Traveler Enrollment Program (STEP) is a free service for US citizens traveling or living abroad. Registration allows the State Department to assist you in an emergency. Enroll at https://step.state.gov/step/.

BY OFFERING TRAVEL TO PARTICULAR DESTINATIONS, BCT DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO THOSE LOCATIONS IS ADVISABLE OR WITHOUT RISK, AND BCT IS NOT LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO ANY DESTINATION. YOUR PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH RISKS.

In the event of emergent health or safety concerns, after BCT has assessed the situation, BCT has sole and absolute discretion whether to proceed with any escorted trip or private departure, or to alter the itinerary.

8. Hazardous Materials

Federal law prohibits passengers from bringing hazardous materials on aircraft.

(1) Federal law forbids the carriage of hazardous materials aboard aircraft in passenger luggage or on a passenger’s person. Violations can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives, and radioactive materials. Examples include paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radiopharmaceuticals.

(2) Limited exceptions apply for small quantities (up to 70 ounces total) of medicinal and toilet articles in luggage, and for certain smoking materials carried on the passenger’s person. 9. Insecticide Notice

Some countries require airlines to treat the passenger cabin with insecticides before flight or while on the aircraft. The DOT publishes the current list at https://www.transportation.gov/office-policy/aviation-policy/aircraft-disinsection-requirements, updated periodically.

10. Air Travel, Schedule Reconfirmation, and Check-In

Your airline ticket is a contract between you and the air carrier, even when purchased through BCT. By purchasing air travel through BCT, you acknowledge that BCT does not have the right to control the operations of independent airlines. BCT is not liable for any personal injury or property damage related to your purchase of air tickets or air travel, including any act, error, omission, injury, loss, accident, or delay caused by an airline. This includes airline failure to deliver services, partial or inadequate service, airline refund or rebooking policies, baggage fees, fuel increases, bankruptcy, or cessation of operations.

BCT does not assume responsibility for air schedule changes. In rare instances, departure taxes from certain countries must be paid in cash and may vary in price. Failure to use a reservation may result in automatic cancellation of all continuing and return flights, and forfeiture of airfares.

Airline e-tickets generally expire one year from issue date unless the carrier’s fare rules state otherwise.

For security reasons, we recommend checking in at least 2 hours before scheduled departure for domestic flights, and at least 3 hours before scheduled departure for international flights. Reconfirm flight times at least 24 hours before scheduled departure for domestic flights, and 72 hours before for international flights.

Frequent flyer mileage accrual is at the discretion of the airline. BCT has no liability if mileage or points are not credited or if upgrades are not allowed. Many airlines do not permit upgrades on certain fare classes or when using miles, status, or certificates.

Seat assignments are not guaranteed even after they are assigned, and BCT has no control over airline seat assignments. Most airlines charge a fee to pre-book a seat.

11. Limitations of Responsibility and Disclosure

BCT acts solely as a booking agent for disclosed principal Suppliers and is not the source or provider of any travel service. Each Supplier is an independent entity with its own management and is not subject to BCT’s control. The Suppliers named in your travel documentation are responsible for providing the services purchased, and you consent to the use of those Suppliers.

A Supplier may determine that itinerary alterations are necessary for any number of reasons, including severe weather. Itinerary alterations are at the sole discretion of the Supplier, and BCT bears no responsibility for those changes.

BECAUSE BCT ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE THAT BCT IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE THAT MAY ARISE OUT OF THESE SERVICES. BCT DISCLAIMS ANY LIABILITY, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING ANY DIRECT, PUNITIVE, SPECIAL, CONSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKED THROUGH BCT, INCLUDING ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY, OR IRREGULARITY INCURRED THROUGH THE FAULT, NEGLIGENCE, WILLFUL ACT, OR OMISSION OF SUCH SUPPLIER OR ANY OF ITS EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES. THIS INCLUDES SUPPLIER FAILURE TO DELIVER OR INADEQUATE DELIVERY OF SERVICES, SUPPLIER CANCELLATION AND REFUND POLICIES, FUEL INCREASES, BANKRUPTCY, CESSATION OF OPERATIONS, AND ANY OTHER MATTERS OUTSIDE BCT’S CONTROL. YOU EXONERATE BCT FROM ANY LIABILITY WITH RESPECT TO THE SAME.

BCT RECEIVES ONLY COMMISSIONS AND FEES FOR TRAVEL TRANSACTIONS. CLIENT AGREES AND UNDERSTANDS THAT ANY RECOVERY FROM BCT WILL BE LIMITED TO THE AMOUNT OF COMMISSION AND FEES ACTUALLY RECEIVED BY BCT FOR THE BOOKING AT ISSUE.

12. Force Majeure

BCT will not be in breach of these Terms, and will not be liable to you, for any failure or delay in performing an obligation under this agreement that is due to causes beyond its reasonable control. These causes include acts of God, accident, riots, war, terrorist acts, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities (including web hosts and internet service providers), equipment breakdown or malfunction, destruction or serious damage to facilities, natural catastrophes (including extreme weather events, floods, and volcanic eruptions), governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy, and any other unforeseen circumstance beyond BCT’s control.

THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.

Each of BCT’s Suppliers has its own Force Majeure provisions. In the event of a Force Majeure, those Suppliers may, in their sole and absolute discretion, vary, postpone, or cancel any itinerary or arrangement. Payment of any refund as a result of non-performance remains in the sole and absolute discretion of the Supplier under its policies. BCT will use reasonable efforts to secure reimbursement for you where possible.

13. Client Conduct

Each participant on any trip is expected to act responsibly and adhere to all behavior guidelines established by BCT and its Suppliers, including dress codes at religious or cultural sites and Supplier dress codes. BCT and any local Supplier reserves the right to remove you from any facility, hotel or resort property, tour location, or means of transportation if your health or conduct appears to endanger yourself or others, disrupts the well-being of other travelers, or interferes with the operation or security of the places you visit. In any such case, no refund will be provided.

When you book with BCT, you accept responsibility for any damage or loss you cause. Full payment for any damage or loss (reasonably estimated if not precisely known) must be paid directly to the accommodation owner, manager, or other Supplier at the time. You must indemnify BCT for the full amount of any claim made against us, including legal costs. BCT is not responsible for any costs incurred concerning a guest removed from a trip or any portion of a trip. You agree not to hold BCT or any of its related entities liable for any actions taken under these Terms. Baggage and personal effects are at all times the sole responsibility of the participant.

The transportation, possession, or use of illegal drugs will result in immediate termination of your trip and may result in prosecution by law enforcement. You are responsible for knowing and observing the licensing laws for drug possession (including prescription and over-the-counter drugs) for all countries and states you are visiting. Some jurisdictions require you to carry a prescription from your doctor.

14. Currency Fluctuations

Currency exchange rates fluctuate, and prices are subject to change based on those fluctuations. BCT is not responsible for surcharges or foreign transaction fees imposed by your credit card issuer or bank.

15. Travel Insurance

BCT OFFERS ACCESS TO TRAVEL INSURANCE TO PROTECT PASSENGERS AND THEIR INVESTMENT IN TRAVEL. UNLESS SPECIFICALLY NOTED, TRAVEL INSURANCE IS NOT INCLUDED IN THE COST OF YOUR ITINERARY. AVAILABLE COVERAGE MAY INCLUDE THIRD-PARTY SUPPLIER DEFAULT AND BANKRUPTCY PROTECTION, TRIP DELAY, INTERRUPTION, MISSED CRUISE CONNECTION, CANCELLATION, MEDICAL EMERGENCY TRANSPORTATION AND EVACUATION, REPATRIATION, BAGGAGE AND PERSONAL EFFECTS, BAGGAGE DELAY, ILLNESS, JOB LOSS PROTECTION, CHANGE OF PLANS, ACCIDENTAL DEATH AND DISABILITY, AND TRAVEL ACCIDENT OR SICKNESS MEDICAL EXPENSES. PROPER INSURANCE MAY PROTECT YOU FROM FINANCIAL LOSS IN ALMOST ALL CIRCUMSTANCES.

Without appropriate travel insurance, if you cancel or interrupt your travel for any reason, portions of the trip may not be refunded, and BCT and Supplier cancellation penalties will apply. This can result in loss of monies up to the full cost of your travel booking and related costs.

The purchase of travel insurance is not required to purchase any other product or service offered by BCT. If you decline insurance, BCT may require you to execute an insurance waiver. BCT is not a licensed insurance broker, and our advisors are not qualified or authorized to answer technical questions about benefits, exclusions, or conditions of any policy, nor to evaluate the adequacy of your existing coverage. An additional charge applies for any travel insurance selected. It is your responsibility to know what your insurance policy covers and to put alternative coverage in place if you wish to insure for excluded conditions.

BCT CANNOT GUARANTEE THAT ANY INSURANCE PROVIDER WILL APPROVE A CLAIM, AND MAKES NO REPRESENTATIONS ABOUT THE EXTENT OF COVERAGE FOR ANY POLICY IT MAY OFFER OR QUOTE.

16. Reservation of Rights and Changes to These Terms

We reserve the right, in our sole discretion, to change these Terms at any time. Updated versions will be posted on our website at https://burnout.ceo and are effective immediately upon posting. Continued use of BCT services after a posted update constitutes acceptance of the updated Terms.

17. General

These Terms are governed by the laws of the State of Michigan, without regard to its conflict of laws principles. You consent to the exclusive jurisdiction and venue of the state courts located in Ottawa County, Michigan, and the United States District Court for the Western District of Michigan, for all disputes arising out of or relating to travel bookings with BCT.

Any claim against BCT must be brought within twelve (12) months after the date of the completion of the trip, and not later. BCT shall not be liable for damages other than compensatory damages, and you waive any right to claim punitive or exemplary damages.

You agree that you may bring claims only in your individual capacity, and not as a plaintiff or class member in any class action, proposed or purported class action, or other representative action, regardless of the type of proceeding. You expressly waive any and all rights to bring class actions, purported or proposed class actions, or representative actions.

If any part of these Terms is determined to be invalid or unenforceable under applicable law, including the warranty disclaimers and liability limitations above, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original, and the remainder of these Terms will continue in effect.

These Terms (and any other terms and conditions referenced here) constitute the entire agreement between Client and BCT with respect to travel bookings made with BCT, and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written. A printed version of this agreement and of any notice given in electronic form is admissible in judicial or administrative proceedings to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

Signature through Travefy, My Travel Planner, or any other electronic signature platform used by BCT constitutes a legal agreement.
